Making a medical negligence complaint
When you’re feeling ill, and you know that taking a couple of aspirin with a glass of water won’t help, your immediate reaction is to seek medical attention at your local surgery, clinic or even hospital.
You want to get better and feel that, given that it’s their job, you expect them to help you recover from your ailment.
While the majority of operations, prescriptions and diagnoses prove to be helpful for patients’ health, errors in healthcare do happen. A lot of mistakes are down to human error, and hospitals, clinics, pharmacies et al inform you of the risks before you undergo surgery or take your medicine, but if something unexpected happens, you feel the need to complain.
Medical negligence comes in many different forms, but when it comes to making a complaint, there are certain things you need to do. The first thing to make sure of is that none of the negligence you suffered was your fault. Secondly, you need to identify who was directly responsible, be it an individual or group of doctors, surgeons, nurses, pharmacists or physicians or the place you were receiving treatment in.
Make the complaint as soon as possible. If the incident of medical negligence is fresh in your memory as it happened within, say, a few weeks or so, then you have more grounds to complain. If you have to take time off work because of others’ mistakes in a medical setting, then this will add weight to your claim.
It’s also worth talking to someone in the legal profession with a background in medical law before you complain. A simple phone call explaining your plight will help you find out if you have grounds to protest to those responsible for the medical negligence you’ve suffered.
